On the painkillers tip . . . I didn't know that would constitute a DUI. Most painkillers I have taken have not strictly forbidden driving. The labels just said be careful when driving or don't drive until you know the effects. So why is that considered a DUI? Doesn't make sense to me unless you are mixing them with illegal drugs or alcohol at the same time.
I agree with you...if he doesn't press charges, what's the point? And really, what evidence will they have that he was under the influence of pain killers. A medical chart will likely only say that he takes the medication but not when, how much, etc. They won't be able to prosecute him without knowing the blood levels to figure out if he would really be intoxicated/influenced by the medication anyway.
