It seems like his lawyer was a bit behind on all of this - if it was filed with the MD court, I would assume that means he's already been served with summons and complaint (although I'm not an expert on MD civil procedure).

PM_Mama - as the others have said, it's a breach of contract claim. There were probably parts of the contract where TLC outlined how Jon & Kate could refer to TLC and the show in their public appearances. There may have been some general "code of conduct" provisions.

One thing that's interesting to me is how people are either very much pro-Jon or pro-Kate. I understand how it's the American way to choose sides in these things, but it's just kind of funny. In my mind, both of them made mistakes - it's not surprising, in that neither appear to be all that intelligent (although Kate seems to have better PR and media relations people), but they certainly have the public choosing up sides.
