Madison carved out the ability of the SCOTUS to interpret the Constitution, they've been forced to carve out a lot of rules over the years. Especially when the 14th Amendment came along, big changes happened.
Which underscores that not all of the Constitution was written 200 years ago. It has been amended numerous times over the last 200+ years.
