I think that you should check out your fraternity's website for specific policy regarding legacies. You can also write a letter of introduction to the chapter for your brother.
I was in a similar situation a few years ago. My sister attended a different college with a D Phi E chapter. Much to my disappointment, my sister didn't go greek.
It just wasn't for her, and I was Vice President of my chapter at the time.
