We have decades of empirical evidence that show, conclusively, that increasing the punishment does not act as a deterrent for major crimes, such as murder and rape. "Scaring the crap" out of a potential rapist is not really an issue, at all, no matter the statistic.

There's literally no other way to run a justice system in a civilized nation.
The only thing that acts as a deterrent toward abusing the system is to protect the rights of the accused - and keeping a high standard (burden) for conviction is to ensure the rights of the innocent, not the rights of the guilty. It's really that simple.
