I was kind of annonyed that they even attempted to make it climatic when Sylar and Peter were laying in a broken mess after the fall. We already knew that Sylar could survive being shot so there was no reason to believe he was dead. Peter absorbs powers and was momments before touching Claire so there was no reason to think he'd stay dead.
