For instance, law school employment after 6 months rates are unreliable. You could be working flipping burgers at McDonalds and the school may count you as employed.

Exactly - now while this may not be a factor for the top schools (Ivy League, MIT, U. of Chicago, Williams, etc., which are at the top no matter how you slice it), it is a factor as you go through the rest of Tier 1 and into Tier 2.
