That makes perfect sense to me, but we've all seen stories where a burglar or robber has tripped over something in the place he/she is ripping off, gets hurt, sues and wins!
Don't you think that the fact that these guys had this "unsafe" swimming pool at their house is going to make them liable no matter what the other circumstances are?
