It's an interesting decision. It's more than likely that a sentence to imprisonment would be a death sentence for this guy. The judge obviously fealt that his crimes weren't enough for a death sentence.

I can see where the judge was coming from. I'm not sure that I agree though.

I read in another article that supporters of short people say that it's about time that the 'unique challenges' the vertically chanllenged face have been recognized by others.

Ummmmmm, and what 'unique challenges' would that be?

Not being able to get on the Tilt-A-Whirl, and half the other rides at the amusement park at the amusement park?

This is ridiculous. Why is physical apperance becoming such a huge factor in the severity of punishment a criminal gets? First the woman that was 'too pretty to go to jail', and now 'you must be this tall to become Big Bubba's Polly Pocket Lover in the slammer'.

WITW was she thinking?? The problem is her "bet" effects children who are vulnerable against a man like that. Too bad if he's short. Probation for him is nothing compared to the lifetime of psychological effects for his victim.

It's funny, he wasn't too short to molest a child, but too short to go to jail. Hmmm, I wonder...

That's exactly what I thought. And it was a 12 year old girl. Chances are that she was nearly as tall or taller than him.

It's not like he's technically a dwarf or midget or little person whatever the current term for it is. He's 5'1. He's not THAT short.

I do NOT like the idea of releasing a child molester back into society immediately like this. What about solitary confinement, for his own good, or other solutions? It's a problem of the prison system if they can't protect their prisoners. It's not an excuse to let a guy out into the world who hasn't been rehabilitated. He will only be electronically monitored for FOUR MONTHS. If the judge was that concerned, then perhaps she should've thought outside the box a little more.

Wonder if we'll be seeing him show up at one of the houses on Dateline anytime soon....

Personally, I don't give a damn if the guy is harmed in jail. If he hadn't broken the law, then he wouldn't be in the position of going to jail in the first place. And the fact that he committed a crime against a child makes the judge's ruling even more asinine. As a mother, I would be absolutely outraged if this happened in my area.

Keep him in isolation if his small stature is that "big" of a problem. Releasing him on probation, even with electronic monitoring, is doing a huge disservice to the community.

Exactly. I was thinking solitary confinement too. A child molester being unsafe in prison is just part of prison life. Oh well. I've known rapists shorter than me, and I'm 5'1 (I used to work in prison). What you find many times are that the smaller/shorter/skinnier people are the tougher/crazier ones because they know they're vulnverable. He did the crime, he can handle it. OH WELL.

It's all well and good to be outraged by this and say "who cares" if somebody convicted of a crime is raped/beaten/whatever in prison. Here's the thing, though -- one day, that guy who was raped/beaten/whatever in prison will be back out on the streets. Do you think that the time spent in prison being raped/beaten/whatever has made him LESS likely to commit crimes and LESS dangerous? If so, pass me some of whatever you're smoking. Is the satisfaction you get from thinking of him being the meat on a big hairy inmate sandwich worth the thought of him getting out in a few years and being even more messed up than he was before, and hey, maybe he'll live near you and your children.

The prison system in this country has been broken for a long time and needs to be fixed. The first step is to stop locking people up for being caught with a joint -- but yeah, how likely is that in this country today?

This is ridiculous. He committed the crime, he should have to pay. Regardless of his physical appearance. If they are so worried, why don't they put him in solitary confinement?

I would have to think that the Judge is in a better position to decide this than you or I.
