Interesting comments on kegs...

I've copied this post from Greek Life by gpb1874...

"here's a fun tid bit of information for you (just heard this at a risk managment presentation and no it was not greek based, but the guy is a lawyer)

If you have a keg (including party balls, keg-erators and the like) at your house (single family and greek), and something happens, insurance will not cover it. if you drank out of a keg, slipped, fell and hurt yourself, your HEALTH insurance will deny the claim (presenter was not sure if that was all states or not). all because you drank out of a keg. Additionally, if you even have a keg at your house (especially those keg-erators that are so common now) and have a problem unrelated to alcohol, the HOME insurance company can and will most likely deny the claim.

he said it doesn't matter who serves from the keg. This applies unless it is a 3rd party vendor, which kinda helps explain why all the HQ's made the rule."

I've never heard this information regarding a private home, but it does back up a lot of Nationals comments about a chapter's insurance denying claims if the rules of the policy are broken.

Scary thoughts.

And know even further more and more national organizations will charge the chapter if they are caught with kegs. I think that Kappa Alpha Order is charging 20 per member per keg. It may even be as high as 50.

Whoa. I feel sorry for any 100+ man chapters with 8+ kegs. That's enough to completely deplete your budget.

Why? Because it's common source? By the same logic, if everyone drank out of a bottle of wine at my house and someone fell down the stairs they could sue too.

This sounds like an urban legend.

DeltAlum 02-24-2006 10:52 AM

Do you own your house? If someone fell down your stairs even if they weren't drinking they could sue you.

People sue McDonalds for serving hot coffee.

Thankfully, most of these folks don't win. But some do.

The point here is that the insurance companies have set certain standards for chapters (or whomever), and if those standards are broken it allows the insurance company to deny a claim.

You answered my question, not so much.

Are you serious? This is not uncommon at all. I think its a 3500 or 5000 dollar fine at our house.

I'm not talking about fraternity or sorority houses, I mean private houses occupied by 21+ people.

georgewallace3 02-24-2006 01:08 PM

the post made by the KA was concerning fraternity houses, so why did you comment

33girl 02-24-2006 01:42 PM

because the original post DID mention family houses. duh!!!!!

If you are serving alcohol, whether in a private home, bar, or fraternity, you are potentially liable for the results. Whether it's wine or a keg.

I think it is an urban legend about the health insurance, but any homeowner's insurance policy is not going to pay for damages that resulted from you serving alcohol negligently. And a keg almost always falls under that category.

Could well be, although the original poster says the speaker was an attorney who said he didn't know if that was true everywhere. Maybe it's a state-to-state thing.

valkyrie 02-24-2006 06:29 PM

Aren't there some insurance companies where they automatically deny almost every claim? I knew people who worked for a crappy law firm where they did insurance defense -- they litigated everything -- when in doubt, deny and litigate.
