In TN, I have been told it would not be illegal if it was consentual. But, the person involved would have to be over 16 for this to happen. So, in TN, it would not be illegal if what I have been told is true.

If this is something you are asking in all seriousness for personal reasons, don't ask GC! Ask a local lawyer!

Illegal is the spelling.

Most states have a 2 year window. A 16 and 18 year old would be legal and a 17 and 19 year old would be legal. Still check with your state laws.

Depending on the jurisdiction, it should not be considered statutory rape. Most states accept the buffer of a couple years difference when they are young and close of age.

I think in most states the age of consent is 16, but I know louisiana and some southern places are still lower. If you have a state in mind, let me know and I can check...

I'm thinking it would depend on your state's age of consent laws.

In Hawai`i, age of consent is 14, but a minor having sex with an adult more than 5 years older is illegal.

A little more info on the rules in TN.The state doesn't allow a person to be more than 4 yrs older than the minor [e.g. a16 yr old can hook up with a 20 yr old and a 17 yr old can hook up with a 21 yr old]. I do believe you are correct about the age of consent being 16, but I'm not entirely sure. My girls have to be at least 18 nowadays.

Are you sure it's just a 2 year window? I know this one guy whos 27 who did a 17 year old and never got in trouble. He hit it for a good minute, too.

Initially the laws were meant protect people in case the older person was obviously being harmful versus being sincerely into the other person. Prosecutors have expanded the scope of the laws through application.

Edited to add: Most states have a four year window.

There is a case where the boy was 4 years and ten days older than his girlfriend. High school Senior and Freshman. Her parents didn't like him so they turned him in to the police. That ten days got him 8 years in prison.

I'm not positive but that's what I remember hearing in high school when I was 17 and dating a 19 year old. I think the age of consent varies by state but I'm pretty sure that's the Florida rule. I could be wrong or it may have changed.
