A civil liberties advocate said the court ruling unsealed Friday was "blatantly unconstitutional."

Monroe County Family Court Judge Marilyn O'Connor ruled March 31 that both parents "should not have yet another child which must be cared for at public expense."

"The facts of this case and the reality of parenthood cry out for family planning education," she ruled. "This court believes the constitutional right to have children is overcome when society must bear the financial and everyday burden of care."

Interesting. When I showed this to one of my co-worker, she said that life is unfair. I asked her why? She said that she can't conceived.

On some level, I agree with the judge. On another, I don't think that's somewhere the government needs to go. Looking at the potential problems versus the benefits of some kind of reproductive licensing program, I could see tons of benefits. However, I could only assume that it would be heavily weighted (mostly due to socio-economic realities) to grant more licenses to white affluent individuals. That's kind of an oversimplified tip of the iceberg objection, but y'all get the idea.

While I think the ruling will so be overuled because there is no precident and I can't find a law that would allow it to stand. But as someone that is tired of people having child after child and being unable to support any of them I admire the judge's spirit ROFL. It's not just about the public money but if you can't take care of the first four what makes me think you can take of any more of them?

I agree. I am sure, or I HOPE, this judge realizes that this sort of ruling cannot stand. What it will do, which is probably what he intended, is draw much needed attention to the public's frustration with having to accommodate people continuously having children that they cannot support. If the State cannot regulate procreation or reproduction, then perhaps more organizations or non-governmental entities can step in and try to reach more people who live that type of lifestyle.

i just want to know what these people are thinking...? why are you going to have more children when you already can't take care of your other ones??? i know alot of people who get frustrated with this issue.

I realize that this order can't stand up. But gawd I wish it would. I don't appreciate a couple having that many kids that I and everyone I know has to pay to raise. Totally not my job.

I too have mixed feelings about this. The judge is right that this couple should have no more children, but is he right when it comes to our liberties? I don't think that he is.

This isnt really on the topic..but something that pisses me off is that I know so many couples trying to have children and can't get pregnant...but it seems a crackhead can pop out a baby when they get good and ready...:rolleyes:

Like I've said before, this is not someplace I want to see the government go because of how easy it would be to abuse this power. But I wish people weren't so friggin' stupid.

It doesn't seem like there's an easy solution to this kind of thing.

Im with Phasad. Im pretty sure they dont let you become a judge unless you have some grasp of the Constitution, so I think this is more of a point the judge is trying to make.

I also agree with you. The judge is making a point, fully knowing that the judgement will overturn.

It would be nice if this sort of ruling could stand. After working in the social work field, specifically with foster children, I agree that some people have absolutely no place having children. The children born to people like this are the ones who suffer and the taxpayers are paying for it, as well.
