Is Hazing legal at church schools?
Here's a new hazing defense tactic. Could it work concerning other laws on religious campuses?
On www.badjocks.com, they said it would be "Open season on freshmen at Notre Dame" and other churchy campuses. Hazing Charged Dropped on Technicality By ABC 11 Hazing charges against five Methodist College football players and two other men have been dropped after lawyers argued the charges violated separation of church and state. One of the players was charged with sodomizing a student with a magic marker, and the other six suspects were charged with misdemeanor hazing. According to a police report, 18-year-old Kent Murphy was pinned to a locker room floor and stripped by teammates after a practice in November. The report says teammates tried to write on his backside with a marker and he was sexually assaulted with it. The players' lawyers successfully argued that because the school is a religious institution, the campus police cannot enforce state law, and they violated separation of church and state when they arrested the students for violating a North Carolina law. The case will now be turned over to the Cumberland County Sheriff's office. |
I went to a catholic univ and we were held to all state and federal laws. I think even our student handbook said something to this fact, also.

As I tried to post last night, this is a case of live by the sword, die by the sword. Schools that do all the disciplining on their own and keep "outsiders" out of the loop are usually much stricter. If it's decided you're guility, you really don't have a prayer (no pun).

Hoosier...like Delt and others, I doubt this will stand. There will be some sort of repercussion - unfortunately, NOT for the fact they did something wrong, but, for all the negative publicity this could bring to the campus.

I agree, not gonna stand. They'll get in trouble. They are still in the United States and the vicitim definalty has rights.
