Student Recovers $245K after Botched Title IX Case
 
Perhaps this should be a shot across the bows for schools employing kangaroo courts in their Title IX investigatory process. Perhaps now, schools will maybe start getting in line letting law enforcement professionals handle these investigations instead of the random assortment of professors and staff that they tend to employ? There's real liability here, and as I have suggested, some real money to be won by students caught up in these administrative processes.

FratPac has been trying to make this point now for quite some time--schools should not be handling rape investigations. Those need to be referred to law enforcement.

Did you actually read the linked article? The money awarded in the suit had to do with a failure to update the wording in the code of conduct.

Yes, they were supposed to update it to the "preponderance of the evidence" standard. That's not why the failure occurred, however. The failure was within the system's treatment of the accused. Preponderance of the evidence is not difficult to prove, and even in a he-said/she-said situation, having tried in a court of law (not to a panel of women's studies professors, mind you), a lot is assigned to credibility and demeanor, things which can be completely arbitrary.
