I heard about this on the news this morning. I think that this suit is idiotic!!! This society is very sue-happy...

I want to sue Subway because despite my sub a day diet, I've yet to lose 200 pounds and I just think that's BS...do I have a case?
Does it matter that I weight no where near 200 lbs, but significantly less? |
I wonder if I can sue MTV for lowering my iq?

Just look at some of the smoking settlements! People made the conscious decision to go and buy a pack a day or whatever and died from it... Did they expect not to have repercussions for their decisions? Did they not know it was harmful? BS! In my opinion this guy made the decision to gorge himself at fast food joints every day and could have just as easily stopped... It's sad that our society doesn't expect people to be responsible for their own stupidity. |

Well.... Playing devil's advocate here but...
I think that selling a product that is so high in fat could be construed as knowingly selling a dangerous product. In America, the leading cause of death as far as I know is still heart disease. Whether it's brought on by excessive fat/cholesterol or smoking or a combination of the two I'm sure is not known. In this fella's case though I'd say his argument will be simply that thse fast food chains knowingly sold a dangerous product and share some of the culpability for his current situation. |
The reason that the suits against tobacco companies were so successful is because the tobacco companies willfully concealed findings that smoking causes cancer. Hell, they even used to promote it as GOOD for you!
AFAIK, I don't think McD's ever portrayed a Big Mac as health food. Unless these fast food places force fed him the stuff, which I HIGHLY doubt happened, this guy has a damn weak case and is just looking for someone to pay him for his own lack of good judgement. The song "Get Over It" by The Eagles really is a good theme song for this whole lawsuit. |
Probably a better comparison would be the successful lawsuits against gun manufacturers for wrongful death...
I heard they put some kind of clamp on that though... I'd have to research it, but it's not that important :D |

Ok this is about as stupid of a lawsuit as that one where the woman spilled hot coffee on HERSELF and sued McDonalds b/c she was burned and didn't know the coffee would be hot. and somehow she won.... Whats next, cheeseburger wrappers that say CAUTION: The contents of this package may make you FAT!
Wow... I hate dumb people who like to waste the taxpayers money with frivolous lawsuits... The obese man, no one force-fed him those big macs and fries, he needs to stop blaming other people and take some responsibility for his own actions. If he wants to rectify the situation, he should get his butt to the gym and get on a lower calorie diet. |

IowaHawkeye, in that hot coffee situataion as I recall they sold the coffee to her so hot that when she took a drink she had 3rd degree burns throughout most of her mouth. Needless to say she'll never taste food again.... I think the suit had merit because the coffee should never have been sold that hot. I also believe the award was significantly reduced from the original 10 million dollars on appeal.
