Verification of Beta Sigma Phi's title IX exemption?
 
So, I've heard from international that BSPhi is exempt from title IX. The trouble is, I can't seem to find any kind of documentation that actually verifies that fact.

I ask, because in the process of becoming recognized on campus as a Greek org we would need to submit proof of this to TPTB.

Anyone know where I'd be able to find this? Or where to start in trying to find such documentation?

I called today and spoke to Lola. She faxed over the articles of incorporation, while it was not what I needed right this second....we were going to need them anyway.

I'll call back tomorrow and speak to Lori.

Actually, it's exactly what you need.

Social fraternities and social sororities incorporated as 501(a) tax-exempt organizations are exempt from Title 9. Look at section a(6) of the statute:

The full cite is 20 U.S.C. 1681(a)(6)(A).

She may need more than that. We had to get a ruling from the Dept. of Education recognizing that we're social, not professional. Don't know whether that might be the case for Beta Sigma Phi, but not being a "traditional" collegiate social sorority, the school might want more than the Articles of Incorporation. I wonder if the non-collegiate nature of BSP could aske a difference.

You're right. She may need to have some sort of statement that the chapter will consist primarily of college students.

I called Lori today. Such a nice lady, just saying. :D

She said that the articles of incorporation, documentation of the tax status of the org and the letter that she sent to me earlier during the FV process stating that this chapter would primarily be made up of college students should be sufficient....we'll see how everything pans out.

Thanks everyone for your insight and advice! The process for campus recognition has officially begun as of today's submission of some important paperwork and I'll keep everyone updated on our progress.
