16 Illegals Sue Arizona Rancher

Quote:

An Arizona man who has waged a 10-year campaign to stop a flood of illegal immigrants from crossing his property is being sued by 16 Mexican nationals who accuse him of conspiring to violate their civil rights when he stopped them at gunpoint on his ranch on the U.S.-Mexico border.

Roger Barnett, 64, began rounding up illegal immigrants in 1998 and turning them over to the U.S. Border Patrol, he said, after they destroyed his property, killed his calves and broke into his home.

His Cross Rail Ranch near Douglas, Ariz., is known by federal and county law enforcement authorities as "the avenue of choice" for immigrants seeking to enter the United States illegally.

The 16 should be happy he just escorted them to the authorities. On property owned by Mexican drug lords along the border they would have just "disappeared".

Now, if he were in Texas he could have just shot them according to our laws.

Pretty much.

You have the right to use force and even threaten excessive and deadly force to expel trespassers.

What civil right does anyone have to trespass?

nikki1920 02-09-2009 07:43 PM

They were on American soil, doesn't that make them Americans?

/sarcasm

What's the story here?

you and me both.

P.S. In Texas you can't round them up and turn them over to police, you'll be the one that gets in trouble.

Would you prefer Aliens?

CrackerBarrel 02-09-2009 08:36 PM

In general I don't believe you can detain someone for trespass and hold them until the police arrive. I doubt there is a real strong likelihood of getting a jury to side with the illegal immigrants against someone trying to stop them from damaging his ranch in a border district in Arizona though.

"Undocumented immigrants" is quite satisfactory. "Illegals" is a classist term.

ETA: Rather, "Illegals" is a term that perpetuates a classist and jingoistic system.

Kevlar281 02-09-2009 09:06 PM

Undocumented? That would imply they had a document to lose.

SWTXBelle 02-09-2009 09:42 PM

Um, I think "illegal" has nothing to do with class, and everything to do with the idea that they are here illegally. I've known of college-educated, white-collar illegal immigrants. They were not in compliance with the law, and so "illegal".

eta - My husband has lost his Social Security card. He is temporarily "undocumented".
