I think what a lot of people say about smoking is the same thing that they would say about drugs, were they legal.... If you do it in your own home, it's whatever. I don't think anyone here who is advocating the legalization of drugs is suggesting that it be ok to be shooting up out on the street or in a bar/restaurant.

The last part I agree with you on though. :)

Nah, the actual irony is that you don't see the parallels between 'drunk in public' (ie being a public nuisance) and public smoking bans - note that 'public' exists here, as private smoking is supported by nearly everyone.

At what point are you 'drunk' in public?

The standard .08 that gets you a DUI?

You can have alcohol in you and not be a nuisance if that is the case. Why would someone smoking a cig. in the park, in the open also be a nuisance.

I think loud people, dogs, and kids are nuisances. Why not ban them as well?

This will depend on both the laws of your state (and I know little about the Code of West Virginia, although I've gotten bombed there) as well as the situation. Again, though, you're missing the point -

You can have cigarettes and not be a nuisance as well. You can't walk around most places with an open beer, right? [NOTE that I mean this 'as a matter of law' - whether or not you can actually do it in a de facto sense is meaningless]

I understand the scale issues you're getting at, but I'm trying to point out a different angle here.

The key here is 'public' nuisance - you don't comprise the 'public', and unfortunately it looks like you disagree with the opinions the public holds.

That sucks, but that's the way it works.

The decissions of what is made legal are done by OUR Duly Elected Moraans!:( They are the ones who decide for us what is good and what is bad. There isnt a friggen one of them that are Santa Claus, keeping in the season!:)

Hell I was a dinner one night with a Friend who is a State Trooper and He had a New Toy. I blew and blew Yellow, been drinking all day.

An other Dinner Guest who had his first drink at the dinner blew Red!:rolleyes:

Okey Dokey!

Just find out what .08 comes out to for drinks! 1-2. OOPS!;)
