welcome to law school. It pretty much changes the way your brain works. You'll associate pretty much everything with some aspect of the law.

Welcome to hell!

folks, hazing is hazing whether it is done by a wrestling team, girls powder puff football team, fraternity or sorority, marching band, or the marine corps.

and if the alleged sexual assualt wasn't a sexual assualt, what was it----a proctology exam?

You just don't get it.

At the very most, this is something that should get the kids put on pre-suspension with maybe one or two who have gotten in trouble in the past getting a suspension.

Thus, there would be only monetary compensatory and perhaps (but not likely) punitive damages.
By the way, that's wrong. If you are kept in a confined space by the threat of force or the perceived threat of force, that's sufficient to prove the tort. The facts above state that the boys were in the pool, and when they attempted to escape, they were shoved back in -- false imprisonment is an easy one here, not to mention assault and battery.

I'm about to go Prosser & Keeton on 'yo azz.

rudey, sweetheart, what don't i get? as an advisor, believe me i know what is considered hazing, and technically, what is described in this article would qualify as hazing. and if someone inserted something into someones rectum without their consent, that could be considered sexual assualt. those were the points i was making. i didn't miss a thing.

You really did miss a thing.

I understand that you have your rules for your sorority that you follow, but this is a whole other world that certain guys understand.

I don't condone people hurting each other. I am a very large advocate of risk management and protecting fraternities by not even doing something that can be misinterpreted. But this is different.

But these guys, in high school, on a sports team, in wrestling, is something you can't understand.

I bet if this crap hadn't happened, the new kids would be walking around with their balls hanging out and doing things that most girls publicly find vile, but then secretly find funny.

Unwanted touching on what is perceived a private part - and probably pretty aggressive goosing - It's sexual assualt. At least, that's what I'm teaching my girls!

Lawyers call it "implied consent".

I think you'd have a decent argument down that path.
