how big of a business is it, is it a franchise? it sounds like it's bigger.
if it's a small business (like Tom's), then they're not necessarily affected by a lot of Title VII and the EEOC regulations.... but that doesn't mean the person wouldn't have a different cause of action. But no matter what action were to be taken, the person being discriminated against would have to partake. If they don't want to do anything, then there's not really a legal leg to stand on. Doesn't mean that company policy would work that way though..... if it's a corporation with a hierarchy,his butt would get canned quickly |

However, an individual, organization or agency can file a EEOC violation charge on behalf of an aggrieved individual in order to protect the person's identity. The EEOC allows this to encourage people who would would otherwise be afraid of retaliation to step forward and blow the whistle. i'm actually thinking of getting into employment law... but who knows. I have a class in it right now, and our appellate brief last year was on national origin discrimination.... so i'm thinking about this little fact pattern way too much for my own good at the moment! |

The man has a right to hire who he wants. However, quota-ing it does not work. It sounds like your boss has poor business skills. If he is making profit, then the only color he ought to be concerned with is $$$green$$$... Other folks suggestions to just examine EEOC regulations on the web is one direction you could take if you are concerned. Another direction is NAACP Legal Defense if it gets really bad at work... My question is: why do you care to begin with? |

sure the man has the right to hire whomever he wants as long as credible facts. To deny or discriminate against someone (ESPECIALLY against those for whom it's been happening for a few centuries) based on race denies equal opportunity for everyone.

Well, it is a franchise and he has at least 20 employees, if not more. I guess my basic concern is getting something done about it (maybe if he just got reprimanded or something) without losing my job. Honestly, since he's not in the store too often and I like everyone else, I don't want to quit. However, if I don't start seeing an improvement within, say, a month, then I would definitely consider an alternative job. What was the NAACP thing you were talking about Monet? Do you have a number or website handy?
