Shouldn't a "I have common sense" affidavit be a requirement on purchase agreements for real estate? It sure would be a cure-all for all these weird situations. It sure would make my job (mortgages) so much easier!

The only good thing, though with these newer airports is that they have designed the property with sizeable clear zones to reduce the noise footprints of jets taking off and landing. DFW, for example, has a ton of open space at each end of the runways that's owned by the airport; but then that's no guarantee that one day the airport board gets a stupid attack and starts selling off the unused space. And then... back to where you started!

Most of your modern jets are Cat III noise reduction compliant, and with prudent noise-abatement takeoff and landing procedures most jets are well over 1000 feet above the nearest house.

On the other hand, DEN, with its high altitude requires very long runways. (I think they're extending all of 'em to at least 15,000 feet in length.)

On this note, some asswhole neighbor who lives like 2 blocks away came out and parked in front of our house, heard a stereo playing and called the cops. He gave one of our guys a "citizen's ticket". It carries a $240 fine.

He said that he had "heard people playing their stereos up and down his street at all hours" and that this was the "first time he's actually caught anyone".

We don't drive on his street or anywhere near it. It's a side street, way out of the way...

Dude needs to get a life.

I understand everyones opinions on the issues.. and personally I would have thought the same thing, but actually in cases like this (every case is different.. different facts and stuff) the woman would probably win. She could actually sue them to be enjoined to stop their current actions.. i.e. stop having parties and the such... force them to move out. its a private nuisance in this instance I believe (no lawyer here, I am studying to become a town planner .. so I have had land use law classes).

There have been a bunch of cases as much as you might not agree wtih them where people have moved in after others and made them stop their actions.. (farming, business, etc.) because it infringes on their right to enjoy their property...

now there are right to farm acts in many states though that prevent surbanites from moving in next to a farm and forcing them to move bc of the smell and such..

Why would this lady buy a house that is next to a fraternity house? Some people purposely put themselves in situations where they can bitch and complain. If I was living next to her I would try to get HER evicted.

Sometimes the law and what people can do with it really defies common sense.

Sometimes what is legal is not morally right.

These guys seem to be trying to be considerate neighbors after they were made aware that their actions disturbed others. Maybe she should plant some trees or a hedge to block the noise and the view! She is stirring up the other neighbors who may or may not have been bothered by the whole situation. I agree that to move into a neighborhood and then complain about your neighbors or wish for different neighbors is dumb. There are other places to live that would meet all of her criteria.

I think it speaks very well of the TKE chapter that no mysterious accidents have occured over at this woman's house though. I'm sure given the situation many other groups would be acting vengefully against the woman, slashing her tires, etc... They're trying to work with her.

They started out at about 12K, with plans for a 15 or 16K runway for international flights. I'm not sure that one has been built yet. I'm not aware that any of the original runways have been extended.

The other thing about DIA (DEN to you) is that it is the largest airport in the world, total size-wise, just because of what you point out. (over 55 square miles) And it is basically surrounded by farmland. Those are among the reasons it was built so far out of town. Also, United, which handles about 70% of DIA's traffic has stopped using 727's all together because of noise.

And they (DIA) have still had to settle millions of dollars in lawsuits -- even after having taken the actions you and I describe.

And, as LXA Alum wrote:

First, may the memory of Stapleton rot in... well, you know. I wonder how much of my life has been spent making circles in the sky over the Eastern Plains because it was sprinkling at Stapleton.

Second, if they do have to do DIA II farther out, it will probably be a nextdoor neighbor to Tom's KCI. The Taxicab lobby will love it, though.
